IMPORTANT INFORMATION
Please read these Website Terms of Use carefully before accessing or using freightservices.com.au (the Website).
The Website is owned and operated by CargoMaster Pty Ltd (CargoMaster, we, us or our).
By accessing or using the Website, you agree to comply with these Terms of Use. If you do not agree, you must discontinue using the Website.
These Terms of Use govern your use of the Website and its content. They do not replace or amend any separate quotation, freight forwarding agreement, transport contract, bill of lading, air waybill, service-specific terms or other agreement entered into with CargoMaster.
1. About CargoMaster
CargoMaster Pty Ltd is an Australian-owned freight forwarding and logistics business providing information about freight, shipping, transport and related services through the Website.
Website: https://freightservices.com.au
Email: info@freightservices.com.au
Telephone: 1300 767 136
The Website provides general information about CargoMaster, its services and freight forwarding matters. Information published on the Website does not, by itself, establish a binding agreement to provide freight or transport services.
2. Acceptance of These Terms
By accessing, browsing, downloading material from or otherwise using the Website, you agree to these Terms of Use and any applicable laws.
You must not use the Website if doing so would breach a law that applies to you or if you lack the legal capacity required to use it.
If you access or use the Website on behalf of a company, business, organisation or another person, you represent that you are authorised to do so. You agree to ensure that your use of the Website complies with these Terms.
If you do not agree with these Terms, your permitted course is to stop using the Website.
3. Changes to These Terms
CargoMaster may amend these Terms of Use from time to time to reflect changes in its business, Website functionality, technology, security requirements or applicable laws.
Updated Terms will be published on the Website and will identify the date of the latest revision. Changes will generally apply from the date of publication to subsequent Website use, subject to applicable law.
Where a change affects an existing contractual relationship or requires notice or consent by law, CargoMaster will comply with the applicable requirements.
You should review these Terms periodically. Continuing to use the Website after updated Terms take effect indicates acceptance of those changes to the extent permitted by law.
4. Permitted Use of the Website
You may access the Website for lawful purposes, including obtaining general information about freight forwarding, shipping, logistics and CargoMaster’s services.
You may view Website pages and print or download reasonable portions of publicly available material for your own personal reference or legitimate internal business use, provided that you:
- retain applicable copyright, trademark and other proprietary notices;
- do not misrepresent the source or ownership of the material;
- do not alter the material in a misleading way;
- do not use the material in a manner that infringes another person’s rights; and
- comply with these Terms and applicable law.
This permission is limited and does not transfer ownership of any Website content or intellectual property to you.
Any use beyond this limited permission requires CargoMaster’s prior written consent, except where that consent is not legally required, including under applicable statutory exceptions.
5. Prohibited Conduct
You must not use the Website in a manner that is unlawful, fraudulent, misleading, abusive, disruptive or likely to harm CargoMaster, the Website, other users or any third party.
Without limitation, you must not:
- attempt to obtain unauthorised access to the Website, its hosting environment, administration systems, servers, databases or associated networks;
- interfere with, disable, damage, overload or disrupt the Website or its infrastructure;
- introduce or transmit malware, viruses, ransomware, spyware, malicious scripts or other harmful code;
- attempt to bypass security controls, authentication measures, access restrictions or rate limits;
- probe, scan or test the vulnerability of the Website or its systems without prior written authorisation;
- impersonate another person or organisation or misrepresent your identity, authority or affiliation;
- use the Website to distribute unlawful, defamatory, threatening, deceptive or infringing material;
- collect, harvest, buy, sell or misuse personal information or email addresses obtained through the Website;
- send spam, unsolicited bulk messages or unauthorised promotional material using Website facilities;
- submit false enquiries, fraudulent freight requests or misleading shipping information;
- copy, reproduce, modify, reverse engineer, decompile or create derivative works from Website software or technical components, except where permitted by law;
- use Website content to create a competing commercial information service or misleading imitation of CargoMaster;
- interfere with another person’s lawful use of the Website; or
- assist, encourage or enable another person to engage in any prohibited conduct.
Nothing in these Terms prohibits conduct that cannot lawfully be restricted, including activities expressly permitted by applicable law.
6. Automated Access, Scraping and Artificial Intelligence
Unless CargoMaster has provided prior written authorisation, you must not use bots, scrapers, crawlers, automated agents, bulk-download tools or similar technology to systematically extract, collect, copy or monitor Website content beyond ordinary, authorised indexing and access.
You must not use automated means to collect contact details, pricing information, commercial information or other Website data for bulk marketing, resale, competitive intelligence or other unauthorised commercial purposes.
You must not circumvent technical measures intended to control access, protect content or maintain Website security.
You must not use Website content to train, fine-tune or build an artificial intelligence or machine-learning system where that use would infringe intellectual property rights, breach these Terms or otherwise be unlawful.
Search engine indexing and other automated access specifically authorised by CargoMaster may be permitted, subject to applicable technical instructions and legal requirements.
CargoMaster may take reasonable technical and legal measures to restrict abusive automated access, protect its content and preserve the availability and security of the Website.
7. Website Information and Accuracy
The Website is provided as a general information resource. CargoMaster endeavours to publish useful and reasonably current information but does not warrant that all content is accurate, complete, current or suitable for every purpose.
Website content may include errors, omissions, outdated information, technical inaccuracies or estimates. Content may be amended, corrected or removed without notice, subject to applicable legal obligations.
Information concerning freight rates, shipping routes, schedules, transit times, customs procedures, cargo requirements, service availability, container dimensions, weight limits, surcharges and delivery estimates is indicative only unless expressly confirmed in a written quotation or separate agreement.
Information may change because of carrier decisions, capacity constraints, weather, port congestion, industrial action, customs requirements, regulatory changes, security measures and other circumstances outside CargoMaster’s control.
You should obtain written confirmation from CargoMaster before relying on Website information to make a significant commercial, financial, logistical or operational decision.
Nothing on the Website constitutes legal, tax, financial, customs, insurance or other professional advice tailored to your circumstances. You should obtain independent advice where appropriate.
8. Freight Services, Quotations and Separate Agreements
A description of a freight or logistics service on the Website is not, by itself, an offer or guarantee that the service is available for a particular shipment.
Any quotation, booking or service engagement may be subject to additional requirements, including cargo details, dimensions, weight, packaging, dangerous-goods declarations, destination restrictions, carrier acceptance, customs documentation, permits, payment arrangements and applicable service terms.
A quotation may be subject to validity periods, exclusions, surcharges, currency fluctuations, carrier rate changes and other conditions stated in the quotation.
Transit times and delivery dates are estimates unless a specific written agreement expressly provides otherwise. A published estimate does not guarantee a delivery date.
CargoMaster may decline a request where permitted by law, including where a shipment is prohibited, inadequately documented, unsafe, incorrectly described, commercially unviable or unable to meet applicable regulatory or carrier requirements.
Once freight services are booked or accepted, the relevant quotation, service agreement, transport document and applicable contractual terms govern that shipment. These Website Terms do not override those documents.
9. Customs, Regulatory Compliance and User-Supplied Information
Importing and exporting goods may involve customs declarations, duties, taxes, permits, biosecurity requirements, sanctions, export controls, dangerous-goods rules and other regulatory obligations.
Website information about customs clearance and regulatory procedures is general information only and should not be treated as a determination that a particular shipment is lawful or cleared for transport.
You are responsible for providing accurate, complete and timely information about your cargo, including its nature, value, quantity, dimensions, weight, origin, destination and any dangerous, restricted or controlled characteristics.
You must not knowingly provide false declarations, misleading descriptions, forged documents or information that conceals the true nature or intended destination of goods.
Where CargoMaster has agreed in writing to perform particular documentation, customs or forwarding functions, the responsibilities of each party will be governed by the relevant service agreement and applicable law.
Additional costs, delays, inspections, penalties or losses resulting from inaccurate information, missing documents, undisclosed cargo characteristics or your failure to comply with applicable requirements may be your responsibility to the extent permitted by law and the relevant contract.
10. Intellectual Property and Copyright
Unless otherwise stated, copyright and other intellectual property rights in the Website’s text, design, graphics, photographs, logos, page layouts, original materials and other content are owned by CargoMaster or used under licence.
All rights are reserved, subject to applicable statutory exceptions and any express written permission granted by the relevant rights holder.
You must not reproduce, republish, commercially exploit, distribute, modify, sell, license or create derivative works from protected Website content without the required permission.
You must not use CargoMaster’s name, logos, branding or other identifying material in a manner that suggests sponsorship, affiliation, approval or endorsement without authorisation.
Nothing in these Terms grants you ownership of CargoMaster’s intellectual property or any licence beyond the limited permissions expressly stated.
If you believe material on the Website infringes your copyright or other intellectual property rights, please contact info@freightservices.com.au with details of the material, the rights claimed and your contact information.
CargoMaster may investigate properly supported complaints and take appropriate action where warranted. Any action will be subject to applicable law and the circumstances of the complaint.
11. User Submissions and Electronic Communications
If you submit an enquiry, document, image, comment or other material to CargoMaster through the Website or by electronic communication, you must have the legal right to provide that material.
You must not submit material that is unlawful, misleading, malicious, confidential without authority, or infringing of another person’s rights.
You remain responsible for the accuracy and legality of information you submit. CargoMaster may request further information or independent verification before acting on a submission.
Unless otherwise agreed in writing or required by law, sending information to CargoMaster does not automatically create a confidential relationship, professional engagement or obligation to accept an instruction.
CargoMaster will handle personal information in accordance with its Privacy Policy and applicable privacy law. Nothing in this section overrides any confidentiality obligation that CargoMaster has expressly accepted or is required to observe by law.
Email and internet communications may be subject to delay, interception, loss, corruption or unauthorised access. Do not transmit highly sensitive information through an insecure channel. Contact CargoMaster to discuss an appropriate method where necessary.
12. Privacy and Personal Information
Your use of the Website may involve the collection or handling of personal information, including information you submit through contact forms or email.
CargoMaster’s handling of personal information is explained in its Privacy Policy, available at:
https://freightservices.com.au/privacy-policy/
You must not use the Website to collect, disclose or process another person’s personal information unlawfully.
Nothing in these Terms authorises CargoMaster to handle personal information in a manner inconsistent with applicable privacy legislation.
13. Third-Party Websites, Services and Content
The Website may contain links to third-party websites, platforms, tools or services for convenience or information.
Unless expressly stated otherwise, links do not mean CargoMaster endorses, sponsors, controls or guarantees the third party or its products, services, content, security or business practices.
CargoMaster is not responsible for third-party websites or services that it does not control. Your access to and use of those services is subject to the third party’s own terms, privacy policies and applicable requirements.
You should independently assess any third-party service before relying on it, submitting information, making a payment or entering into an agreement.
To the extent permitted by law, CargoMaster excludes responsibility for loss arising from your use of third-party websites or services, except to the extent that such loss is caused by conduct for which CargoMaster is legally responsible.
14. Website Availability and Security
CargoMaster may maintain, update, suspend, restrict or discontinue any part of the Website where reasonably necessary for maintenance, security, operational, commercial or legal reasons.
CargoMaster does not guarantee that the Website will always be available, uninterrupted, error-free, compatible with every device or free from harmful code.
CargoMaster takes reasonable steps appropriate to its circumstances to maintain the Website, but internet services and connected systems involve risks that cannot be entirely eliminated.
You are responsible for maintaining appropriate security on your own devices and systems, including keeping software updated and using suitable security measures.
To the extent permitted by law, CargoMaster is not liable for loss caused by interruptions, transmission failures, unauthorised access, malicious attacks or technical faults beyond its reasonable control, except where the loss results from conduct for which CargoMaster cannot lawfully exclude liability.
Nothing in this section authorises either party to disregard applicable privacy, cybersecurity or other legal obligations.
15. Limitation of Liability
To the maximum extent permitted by applicable law, CargoMaster excludes liability for loss arising from or connected with access to, use of, inability to use or reliance on the Website or its general informational content.
This includes, where legally excludable, indirect or consequential loss, loss of profit, revenue, anticipated savings, business opportunity, goodwill, data or business interruption.
CargoMaster does not guarantee that Website content will be error-free, complete, continuously available or suitable for a particular purpose.
However, these exclusions apply only to the extent permitted by law. They do not exclude, restrict or modify any consumer guarantee, statutory right, remedy or liability that cannot lawfully be excluded, restricted or modified.
Where the Australian Consumer Law or another mandatory law applies, CargoMaster’s liability will be determined in accordance with that law. Any limitation or substitution of remedies will apply only where legally permitted and appropriate to the relevant supply.
Where a loss is caused by multiple factors, the allocation of responsibility will be determined under applicable law and any enforceable agreement between the parties.
Nothing in these Terms excludes liability for fraud or other conduct where exclusion is prohibited by law.
16. Indemnity
To the extent permitted by law, you agree to indemnify CargoMaster Pty Ltd and its officers, employees and authorised representatives against reasonable losses, liabilities, damages, costs and expenses, including reasonable legal costs, arising from a third-party claim to the extent that the claim results from:
- your unlawful use of the Website;
- your material breach of these Terms;
- your infringement of another person’s intellectual property, privacy or other legal rights;
- information or material you submit that is unlawful or infringes another person’s rights;
- your introduction of malicious code or deliberate interference with the Website or its systems; or
- your fraudulent, reckless or wilfully wrongful conduct in connection with the Website.
This indemnity applies only to the extent that the relevant loss or claim is caused or contributed to by your conduct or breach. It does not apply to the extent a loss is caused by CargoMaster’s own conduct, negligence, breach of contract or other liability, where that exclusion is prohibited by law.
CargoMaster will not seek to recover the same loss more than once. Where appropriate, CargoMaster may require reasonable cooperation in responding to a claim and may take reasonable steps to mitigate its loss.
Nothing in this clause creates an indemnity for liabilities that cannot lawfully be transferred to you or limits any rights you have under applicable law.
This Website indemnity is separate from any indemnity, liability allocation or insurance provision contained in a freight forwarding agreement, transport contract or other service-specific contract.
17. Suspension and Termination of Access
CargoMaster may, where reasonably necessary and legally permitted, suspend, restrict or terminate access to all or part of the Website if it reasonably believes that a user:
- has materially breached these Terms;
- is using the Website unlawfully or fraudulently;
- is attempting unauthorised access or interfering with Website security;
- is distributing malicious code or conducting abusive automated activity; or
- is creating a material risk to the Website, CargoMaster or other users.
Where practicable and appropriate, CargoMaster may provide notice, but it is not required to provide advance notice where immediate action is reasonably necessary to protect security, prevent harm or comply with law.
Suspension or termination does not affect rights or liabilities that accrued before the relevant action. Provisions that by their nature are intended to continue, including intellectual property, indemnity, liability limitations and dispute provisions, will continue to apply to the extent permitted by law.
18. Complaints and Intellectual Property Reports
If you believe that Website content is unlawful or infringes your rights, please send a written notice to:
Email: info@freightservices.com.au
Your notice should include:
- your full name and contact details;
- identification of the relevant Website page or material;
- a description of the right or legal interest involved;
- an explanation of the alleged infringement or unlawful conduct;
- supporting information reasonably necessary to assess the complaint; and
- the action you are requesting.
Please ensure that your complaint is accurate and made in good faith. CargoMaster may request additional information before taking action.
CargoMaster will assess complaints in light of the information provided and applicable law. Where appropriate, it may remove or restrict access to material, seek clarification or take other reasonable steps.
19. Governing Law and Disputes
These Terms of Use are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia, except where mandatory laws require otherwise.
Subject to any non-excludable rights, the parties submit to the jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from those courts.
Nothing in these Terms prevents a party from seeking urgent interim relief where appropriate or restricts any right to bring a claim before a tribunal or court that has jurisdiction under applicable law.
The parties may attempt to resolve a dispute through good-faith discussions before commencing proceedings, where appropriate. This does not prevent either party from taking urgent action or exercising a statutory right.
No mandatory arbitration requirement applies under these Terms unless the parties separately agree to it in a valid written agreement.
20. Separate Freight and Commercial Agreements
These Terms govern the Website only.
Freight forwarding, transport, shipping, customs brokerage, storage, packing, insurance-related arrangements and other services may be governed by separate written quotations, booking confirmations, service agreements, transport documents and applicable terms.
If a separate agreement applies to a particular service, that agreement governs the relevant service to the extent of any inconsistency, subject to applicable law.
Nothing in these Website Terms changes a separate agreement unless the parties expressly agree in writing to that change.
21. General Provisions
Severability: If a provision of these Terms is found to be unlawful, invalid or unenforceable, it will be read down to the extent necessary where legally possible. If it cannot be read down, it will be severed without affecting the remaining provisions.
No waiver: A failure or delay by CargoMaster to exercise a right does not constitute a waiver of that right. A waiver must be established in accordance with applicable law.
No partnership or agency: These Terms do not create a partnership, joint venture, employment, agency or fiduciary relationship between you and CargoMaster.
Assignment: You must not transfer your rights or obligations under these Terms without CargoMaster’s prior written consent, except where applicable law provides otherwise. CargoMaster may transfer or restructure its rights and obligations where legally permitted and without diminishing any non-excludable rights you hold.
Entire website agreement: These Terms, together with any applicable Website policies expressly incorporated into them, govern your use of the Website. They do not replace a separate agreement governing freight or other services.
Electronic communications: Communications may be provided electronically where permitted by law. Nothing in these Terms removes a legal requirement for a particular notice, signature or form of service.
